Forbidden Gearhouse Warranty Policy

At Forbidden Gearhouse, we are dedicated to providing top-quality products and ensuring customer satisfaction. Our warranty policy is designed to align with the consumer guarantees under the Australian Consumer Law (ACL) while offering additional assurance to our valued customers.

1. Consumer Guarantees: Our products come with guarantees that cannot be excluded under the Australian Consumer Law. These guarantees include, but are not limited to, assurances of acceptable quality, fitness for purpose, and compliance with description or sample.

2. Express Warranty: Forbidden Gearhouse offers a warranty period of 12 months from the date of purchase or from the date of installation, whichever occurs later, provided that the installation is performed by Forbidden Gearhouse or a third party arranged by Forbidden Gearhouse.

3. What is Covered: This warranty covers manufacturing defects encountered during normal use of the product, subject to the terms and conditions outlined herein.

4. What is Not Covered: This warranty does not cover damage resulting from misuse, abuse, accidents, unauthorized modifications, neglect, or acts of nature. It also does not cover normal wear and tear, cosmetic damage, or damage caused by improper maintenance or cleaning.

5. Warranty Claim Process: To make a warranty claim, please contact our customer service department at brad@forbiddengearhouse.com.au . You will be required to provide proof of purchase or installation date and details of the issue. We will assess your claim in accordance with the ACL and our warranty policy.

6. Consumer Rights: Consumers are entitled to a repair, replacement, or refund for products with major failures under the ACL. If the issue does not constitute a major failure, we will repair or replace the product at our discretion.

7. Limitation of Liability: Forbidden Gearhouse shall not be liable for any incidental, consequential, indirect, or punitive damages arising from the use of our products, to the extent permitted by law.

8. Modification of Warranty Policy: Forbidden Gearhouse reserves the right to modify or amend this warranty policy at any time without prior notice. Any such changes will be effective immediately upon posting on our website or distribution to our customers.

10. Governing Law: This warranty policy shall be governed by and construed in accordance with the laws of Australia, specifically the Australian Consumer Law.

Entire Agreement: This warranty policy constitutes the entire agreement between the customer and Forbidden Gearhouse regarding the warranty coverage of our products and supersedes all prior or contemporaneous communications and proposals, whether oral or written, relating to such subject matter.

Forbidden Gearhouse Intellectual Property

​At Forbidden Gearhouse, we invest significant resources in the development and innovation of our products. We value our intellectual property rights and take measures to protect them. This Intellectual Property Policy outlines our guidelines regarding the use and sharing of our proprietary information, designs, and products.

1. Ownership of Intellectual Property: All intellectual property rights, including but not limited to trademarks, copyrights, patents, trade secrets, and proprietary designs, associated with Forbidden Gearhouse products and materials, belong exclusively to Forbidden Gearhouse. Customers do not acquire any ownership rights or licenses to our intellectual property by purchasing our products.

2. Prohibited Actions: Customers are strictly prohibited from sharing, distributing, reproducing, or reverse engineering Forbidden Gearhouse products, designs, or proprietary information with any third parties, including other companies or competitors. This prohibition extends to sharing physical products, digital files, schematics, or any other form of information related to Forbidden Gearhouse products. All third parties, including other companies or competitors, will also be deemed as in breach of this policy.

3. Non-Disclosure Obligation: Customers who purchase Forbidden Gearhouse products agree to maintain strict confidentiality regarding any proprietary information or designs they may have access to. This includes refraining from disclosing such information to third parties without the express written consent of Forbidden Gearhouse.

4. Unauthorized Use: Any unauthorized use or sharing of Forbidden Gearhouse intellectual property may result in legal action, including but not limited to injunctions, damages, and other remedies available under intellectual property laws. Forbidden Gearhouse reserves the right to pursue legal action against individuals or entities found to be in violation of this policy.
